1. Acceptance of Terms
By accessing or using the Hiring Heroes platform ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Platform Description
Hiring Heroes is a marketplace that connects homeowners ("Consumers") with independent service providers ("Providers") who are active or retired firefighters. Hiring Heroes does not employ Providers, does not perform home services, and is not a licensed contractor in any jurisdiction.
3. Marketplace Only — No Employment Relationship
Providers on this Platform are independent contractors, not employees or agents of Hiring Heroes. Hiring Heroes makes no representations regarding the quality, safety, legality, or fitness of any services performed. Any agreement for services is solely between the Consumer and the Provider.
4. Account Security & Shared Devices
You are solely responsible for maintaining the confidentiality of your account credentials. If you access the Platform from a shared, public, or third-party device (such as a library computer, hotel computer, or another person's device), you must log out after each session. Hiring Heroes implements automatic session expiration after a period of inactivity as a security measure; however:
- Hiring Heroes is not liable for any unauthorized access to your account resulting from your failure to log out of a shared device.
- Hiring Heroes is not liable for any loss, damage, or exposure of personal information resulting from use of a shared or unsecured device.
- You agree to notify Hiring Heroes immediately at admin@j-atchison.com if you suspect unauthorized use of your account.
5. Provider Vetting Disclaimer
While Hiring Heroes requires Providers to self-identify as active or retired firefighters, Hiring Heroes does not independently verify, license, bond, or insure any Provider. Consumers are encouraged to independently verify credentials, licenses, and insurance before hiring any Provider. Hiring Heroes expressly disclaims any liability for services performed by Providers.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Hiring Heroes and its owners, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to:
- Services performed or not performed by any Provider
- Unauthorized access to your account due to use of a shared device
- Any disputes between Consumers and Providers
- Any errors, interruptions, or inaccuracies on the Platform
In no event shall Hiring Heroes' total liability exceed the amount paid by you to Hiring Heroes in the twelve (12) months preceding the claim.
7. Indemnification
You agree to indemnify and hold harmless Hiring Heroes and its affiliates from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your interactions with any Provider or Consumer.
8. Prohibited Use
- You may not use the Platform for any unlawful purpose.
- You may not post false, misleading, or fraudulent information.
- You may not attempt to circumvent the Platform to avoid fees.
- Providers may not misrepresent their firefighter status or credentials.
9. Termination
Hiring Heroes reserves the right to suspend or terminate any account at any time for violation of these Terms or for any reason at its sole discretion.
10. Governing Law
These Terms are governed by the laws of the State of [State], without regard to conflict of law principles. Any disputes shall be resolved in the courts of [County], [State].
11. Changes to These Terms
Hiring Heroes reserves the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.
